Terms of Service

1. Agreement to Terms

By accessing or using Payload (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Payload is a trip planning application that allows users to create routes, mark points of interest, and export data for cycling and bikepacking adventures. The Service is provided for personal, non-commercial use.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must provide accurate, current, and complete information when creating an account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

4. Subscriptions & Payments

Pro subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time. Access continues until the end of your current billing period.

Refunds are generally not provided for partial billing periods or unused time.

5. User Content

You retain ownership of content you create (routes, trips, notes). By using the Service, you grant us a license to store and process your content to provide the Service.

You are solely responsible for content you create and share. Do not share content that is illegal, harmful, or infringes on others' rights.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its servers
  • Scrape, harvest, or collect data from the Service without permission
  • Use the Service to transmit malware or harmful code

7. Service Availability

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time without notice or liability.

8. Termination & Discontinuation

We reserve the right to terminate or suspend the Service, in whole or in part, at any time and for any reason, with or without notice. In the event of service discontinuation, we will make reasonable efforts to provide advance notice and allow data export. We shall not be liable for any termination or discontinuation of the Service. No refunds will be provided for prepaid subscription periods if the Service is discontinued.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROUTES OR DATA PROVIDED ARE ACCURATE, SAFE, OR SUITABLE FOR ANY PURPOSE. ALWAYS VERIFY ROUTES AND CONDITIONS BEFORE EMBARKING ON ANY TRIP.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYLOAD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, GOODWILL, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Payload and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.

12. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
